Owning a federal trademark registration on the Principal Register provides a number of
advantages, including:
- Legal presumption of your ownership of the mark and your exclusive right to use the mark
nationwide on or in connection with the goods/services listed in the registration (whereas a
state registration only provides rights within the borders of that one state). Your trademark registration is evidence of your priority in the trademark.
- Public notice of your claim of ownership of the mark. Probably the most important benefit of placing a mark on the Principal Register is that anybody who later initiates use of the same or a confusingly similar trademark may be presumed by the courts to be a "willful infringer" and therefore liable for large money damages.
- Prevent importation of infringing goods. Having a federal registered trademark gives you the ability to record the U.S. registration with the U.S.Customs and Border Protection Service
to prevent importation of infringing foreign goods.
- Use the federal registration symbol “®”.
- Ability to bring an action concerning the mark in federal court. Without a federally registered trademark, you are not entitled to sue in federal court to enforce your rights.
- Foreign Registration. The use of the U.S.registration as a basis to obtain registration in foreign countries.
